The Website has a specific area for consumer’s e-commerce. The terms and conditions of products sale available at the bottom of the page of the Website will apply to the purchase of products via the e-commerce.

The user shall verify, before making any decision, including those relating to the purchase, the accuracy of the information published on the Website. The Company declines any responsibility for any mistake or omission resulting from the use of data and information on its Websit. The user accepts that communications made through the Website, including email communications, are not confidential.

The Website, considered in its entirety, as well as all material contained therein, is protected by copyright and other intellectual property laws. The contents, materials, databases, works published or otherwise present on the Website, including, by way of example but not limited to, trademarks, logos, images, photographs, press releases and documents in general reproduced, as well as the application software, html codes, are the exclusive property of the Company, or used with the authorization or license of the relative rights holder. GENERAL TERMS AND CONDITIONS

The offer and sale of products on our E-commerce are governed by these General Conditions of Agreement, which, together with the order form, constitute the contract (hereinafter the “Agreement”) that governs the relationship between Perris Store srl, with registered office in Via Agostino Bertani 2, VAT Number 08196150968- hereinafter the Perris Store  and the Customer

The General Conditions are subject to change by the Perris Store, it being understood that, in the relationship with the Customer, the rules published on E-commerce at the time of the order by the Customer will apply.

The Customer can request any information directly on the E-commerce in the CONTACT US area. The languages available to conclude the Agreement are: Italian; English.

  1. Definitions

The following terms and expressions shall have the meanings set forth below for each, which shall remain the same, whether singular or plural:

Personal Area”: means that section of E-commerce intended for the exclusive use of the Customer, through which the Customer can, after authentication, access specific functions provided by the Perris Store;

Customer”: means any Consumer who purchases one or more Products through E-commerce, acting in accordance with the contract;

Consumer”: means the natural person acting for purposes not related to the business, commercial, craft or professional activity carried out, aged 18 years or older;

E-commerce”: means the virtual store available at the URL [https://www.perris-store.com/] by means of which you can purchase the Products;

Order Form”: means the electronic document containing the indication of the Products chosen by the Customer, as well as the determination of the price and the method of payment;

Offers”: the electronic document containing the essential details of the Product and the relevant purchase price;

Parties” meansPerris Store and Customer jointly;

Products”: means the items offered in the E-commerce for the purpose of their sale;

  1. Item

The Agreement governs the online sale of Products by the Perris Store to the Customer.  The Customer will purchase the Product through the Perris Store’s E-commerce, after accessing a Personal Area where s/he must register with personal credentials.

  1. Offers

The Products and the related Offers are presented on the E-commerce within each product sheet.

The images and/or colors of the items offered for sale reproduce as faithfully as possible the real characteristics of the Products. However, these images are intended as illustrative, not being able to correspond perfectly to reality, for reasons of a technical nature. Consequently, the Perris Store cannot be held responsible for any inadequacy of the images of the Products represented in the E-commerce if this is due solely to technical reasons.

The Perris Store offers its Products for sale both to Customers who qualify as Consumers and to Customers who do not qualify as Consumers; if the Customer does not qualify as a Consumer, we invite the Customer to register and authenticate himself as a professional and to access the offer of Products aimed at professionals in the appropriate section of E-commerce.

In view of its commercial policy, the Perris Store reserves the right not to follow up (through these General Conditions) orders from persons other than consumers or orders that do not conform to its commercial policy, or that appear abnormal or fraudulent, at its sole discretion, even without providing any notice to the customer. In any case, the Perris Store reserves the right not to accept orders that appear abnormal in relation to the quantity of products purchased, or the frequency of purchases made. It is expressly forbidden for the Customer to resell, rent, lease or transfer for any reason or for any commercial and/or professional purpose the Products purchased through E-commerce.

  1. Product Availability

With regard to each Product available in E-commerce, Perris Store shall indicate whether the same:

  1. is available from their warehouses and can be purchased online;
  2. is not available or cannot be purchased online;

The Perris Store explicitly reserves the right not to indicate the availability of the Products indicated in the E-commerce. The Perris Store may not process purchase orders that present incomplete or incorrect data, or if the Products are not available.

The type of Products published and their availability may change at any time, without this entailing any responsibility of the Perris Store towards the Customer. The indication of the availability of the Products is not binding, it being understood that the Products indicated as “not available” cannot be ordered by the Customer. In the event that the Products presented in E-commerce are no longer available or on sale at the time of sending the Order Form and the Perris Store is not, consequently, in a position to follow up on the purchase Offer, the Perris Store will inform the Customer of this circumstance by e-mail, refunding the amount previously paid within 15 (fifteen) days from the date of the order.

The prices of the Products and delivery costs may be subject to updates and are to be intended inclusive of VAT, where applicable. If the price of a Product is discounted, according to the indicated discount percentage, such indication will refer to the price practiced within the E-commerce on the day before the discount. The prices of the Products, including taxes and duties, are indicated in the product sheet. Shipping costs, included in the total cost shown in the Order Form, are charged to the Customer in a lump sum that varies according to the total volume of the shipment. The prices of the Products are valid until the completion of the purchase procedures.

  1. Purchase Conclusion

6.1. Registration In order to proceed with the purchase of the Products present in the E-commerce, a registration procedure is required. In order to register, the Customer must correctly fill out and send the appropriate registration form using the tools offered from time to time, indicating their data, truthfully, in the fields provided. Following this procedure, a dedicated Personal Area will be created and granted to the customer, who can view their purchases and change their credentials. The Personal Area will be made available by the Perris Store for an indefinite period of time, until further notice. The Perris Store reserves the right to verify that the e-mail provided by the Customer is correct, by sending an appropriate e-mail to the Customer and requesting the opening and consultation of the link contained therein. The Customer may, at any time, request the cancellation of his/her Personal Area, by sending an e-mail to the e-mail address info@perris.store, communicating the data that may be required.

6.2. Login In Inorder to proceed with the purchase of Products, the Customer must authenticate himself by entering his credentials in the login area.

6.3. Conclusion of the purchase Once authenticated, the Customer may proceed with the purchase of the Product. Before proceeding with these operations, the Customer is required to read the Agreement, paying particular attention to the clauses on the right of withdrawal, as well as to print a hard copy and store another copy on a durable medium that allows the Customer to keep the information that is personally addressed to him/her, so that it can be accessed in the future for a period of time adequate to the purposes for which it is intended and that allows the identical reproduction of the information stored therein. A copy of the General Terms and Conditions will be sent to the Customer by e-mail, upon confirmation of receipt of the order.

In order to proceed with the purchase of Products on E-commerce, the Customer must fill in the Order Form in electronic format and send it to the Perris Store, electronically, following the instructions given each time. Before sending the Order Form, the Customer is required to identify and correct any errors in the data entered. Should the data not conform, it is possible to proceed with the modification, by clicking on the “modify data” button. In any case, Perris Store will send the Customer an e-mail containing a summary of the information already contained in the Order Form, as well as a copy of the Agreement itself. In this regard, the Customer is required to verify the receipt of such documentation, viewing, if necessary, his own spam mailbox.

The Customer must also verify the final sale price before submitting the relative Order Form, it being understood that the price applied to the Product will be the one indicated on the E-commerce, at the time the order is placed by the Customer. If the Customer notices any irregularity, he/she must promptly notify the Perris Store. The Agreement will be considered concluded when the Perris Storereceives, by electronic means, the Order Form correctly completed, transmitted by the Customer, after verification of the successful payment. With the transmission of the Order Form, the Customer confirms that he/she has understood and accepted the Agreement, as well as the additional information contained in the E-commerce. Once the Agreement is concluded, Perris Store will take charge of the purchase order.

The Customer may pay the price due by credit card, prepayed credit card, PayPal (with a PayPal account), through bank transfer, or payment at the physical store, or by other means of payment, as indicated in the E-commerce.

The Perris Store reserves the right to change or implement, at any time, the means of payment that can be used by the Customer, it being understood that the means of payment indicated in the e-commerce at the time the Customer sends the order will be used.

In the event of payment by credit card, the price will be charged to the Customer once the credit card details have been verified and the authorization to charge the Customer’s credit card has been received from the company issuing the card.

The credit card data transmitted during the electronic purchase procedure, such as card number, expiration date and CVV code, are protected and transmitted directly to the banking company that handles payments. The payment takes place directly on a secure server and is protected with SSL encryption key, so as to guarantee the absolute safety of the transaction.

The Customer, by clicking on the “store” box, agrees that the credit card number and its expiration date will be kept and stored for the following orders.

In case of payment by PayPal, at the time of transmission of the order by the Customer, the web session will be transferred to the secure website of PayPal. On this site, the customer can pay the price using his PayPal account, in accordance with the terms and conditions of use provided by the PayPal service, signed by the customer at that time or previously, without communicating, in this way, their financial information to the company. The debiting of the price on the PayPal account takes place at the same time as the sending of the order confirmation. In no case, the price of the Products may vary depending on the payment instrument selected.

  1. Credential Security

Only the Customer must use the credentials for registration and access to the Personal Area. These credentials must not be given to third parties. The Customer undertakes to keep them secret and to ensure that no third party has access to them, adopting all appropriate security measures, in order to reduce the risk of unauthorized access, not allowed or, in any case, not in accordance with their Personal Area. The Customer also agrees to inform the Perris Store promptly, if he suspects unauthorized, prohibited and/or non-compliant access to his Personal Area for E-commerce purposes. The Perris Store reserves the right to verify that the e-mail in the archive is correct, by sending a suitable e-mail to the Customer and requesting the opening and consultation of the link contained in the e-mail itself. The Customer guarantees that the personal information provided during the registration procedure, as well as in subsequent phases, is complete and true.            

Perris Store is not obligated to ship the Products until it has received payment of the price. Upon receipt of payment of the price, Perris Store agrees to ship the Products within the period of five (5) business days [no later than 30 days after the conclusion of the Agreement]. Shipment is available worldwide, excluding Ukraine, Russia and Belarus.

  1. Delays in deliveries

If, for reasons not attributable to the Perris Store, it is not possible to deliver the Product in the manner and within the time indicated, the Perris Store will notify the Customer, indicating, where possible, new times and methods. The Customer, by concluding the Agreement, accepts the possibility of such delays. If the delay in delivery exceeds 90 days, the Customer shall be entitled to terminate the Agreement.

Perris Store guarantees the shipment of the Products, through express couriers selected according to the Product and the place of destination. The Customer can check the status of orders through the “Order Tracking” function provided by the courier chosen for delivery and available in the Personal Area of the E-commerce. The Customer can carry out this verification only after the Products have been shipped.

The documents provided for each Product will be in Italian or English.

Versions of the documents in other languages and/or eventual further documentation must be requested in writing by the Customer before sending the Order Form and will involve the charge of a handling fee, as indicated on the E-commerce. If such documentation is requested by the Customer after the Order Form has been sent, the request must be approved in writing by the Perris Store and, if the Products have already been shipped, the costs of shipping such documents will be charged to the Customer.

  1. Packing

Packaging is free of charge only for standard products in the Perris Store catalog.

Special packaging, if requested, must be approved by Perris Store and its cost will be borne by the Customer and declared in the Order Form or, if requested later, when the Order Form is sent, but in any case before shipment, such cost will be communicated in writing by Perris Store.

Each Product sold through E-commerce is subject to the legal warranty, provided directly by Perris Store, within the terms of the law: Perris Store will be held liable when the lack of conformity of a Product becomes apparent within the term of 2 (two) years from delivery.

The warranty must be asserted directly by the Customer within 2 (two) months from the discovery of the defect of the Product, by sending to the Perris Store a registered letter with return receipt or equivalent technology, to the address in the introduction, indicating the defect found. The Customer is required to keep the proof of purchase of the Product. In any case, the Customer shall forfeit the right to recovery if he does not report the defect to the Perris Store within 2 (two) months from the date on which he discovered it.

Unless proven otherwise, defects in conformity that become apparent within 6 (six) months from the time the Product was delivered shall be presumed to have existed on that date, unless this is inconsistent with the nature of the Product or the nature of the defect in conformity.

The warranty described here applies to normal wear and tear of the Product. On the contrary, it will not apply in case of modification made to the Product, in case of inappropriate use of the Product or in case of non-compliance with the maintenance rules of the Product itself.

  1. Guarantees offered

After reporting the lack of conformity, Perris Store reserves the right to offer the Customer appropriate remedies available.

In the event of a lack of conformity, the Customer is in any case entitled to have the conformity of the Product restored, free of charge, and may choose, alternatively, to have the defective Product repaired or replaced by the Perris Store, without further charge, or to have the price suitably reduced or the Agreement terminated, in accordance with what is defined below.

15.1. Repair and replacement

For the purposes of restoring the conformity of the Product, the Customer may choose between repair and replacement, provided that the remedy chosen by the Customer is not impossible or, compared to the alternative remedy, does not impose disproportionate costs on the Perris Store, taking into account all the circumstances, in particular

  1. the value of the Product in the absence of the conformity defect;
  2. the extent of the lack of conformity;
  • the ability to pursue the alternative remedy without significant inconvenience to the Customer.

The Perris Store may refuse to make the Products compliant if repair or replacement is impossible or if the costs it would incur are disproportionate, taking into account all the circumstances of the case, including those indicated above.

Repair or replacement shall be made:

  1. without charge to the Customer;
  2. Within a reasonable period of time;
  • without significant inconvenience to the Customer.

If it is necessary to remedy the lack of conformity by repairing or replacing the defective Products, the Customer is obliged to make them available to the Perris Store, according to the procedures indicated by the Perris Store, which will take back the replaced Products at its own expense.

15.2. Price reduction or termination

The Customer shall be entitled to a pro rata reduction in price or termination of the Agreement in any of the following cases:

  1. Perris Store has failed to repair or replace the Products or Perris Store has refused to make the Products compliant;
  2. a lack of conformity appears, despite the Perris Store’s attempt to restore the Product’s conformity;
  • the lack of conformity is so serious as to justify an immediate reduction in price or termination of the Agreement;
  1. Perris Store has stated, or it is clear from the circumstances, that it will not restore the Product to conformity within a reasonable period, or otherwise without significant inconvenience to Customer.

In any case, a slight lack of conformity for which it has not been possible or is excessively expensive to carry out the remedy of repair or replacement does not entitle the Customer to terminate the Agreement. The Perris Store is required to prove whether the lack of conformity is minor.

The price reduction is proportional to the decrease in the value of the Product received by the Customer compared to the value of the Product itself, had it been in compliance.

15.3. Carrier and shipments

Shipping costs for the purposes of exercising the guarantees defined herein are borne by the Perris Store, which may decide, at its discretion, the carrier to be used and the manner of shipment. The Customer, for its part, is required to comply with the shipping conditions defined by the Perris Store.

15.4. Re-credits

Any credit of amounts due under the Guarantee shall be made by Perris Store in a reasonable time, in accordance with the Agreement, by the same instrument used by Customer to enter into the Agreement, unless Customer has expressly notified Perris Store otherwise.

  1. Additional guarantees

Additional commercial warranties, offered by manufacturers or third parties, shall bind the latter in accordance with the conditions set forth in the relevant commercial warranty statement and advertising, and shall be deemed to be unrelated to the relationship between the Perris Store and the Customer.

  1. After-sales service

Perris Store provides the Customer with an after-sales service, which can be contacted, for any need, at the following email address: info@perris.store. The Perris Store reserves the right to provide after-sales service through authorized suppliers indicated in the E-commerce or communicated in response to the request for assistance made by the Customer.

  1. Verification of Product Integrity

The Customer is required to verify, at the time of delivery of the Product, that the packaging and/or the Products are intact, undamaged and unaltered. Any damage to the packaging or to the package of the Products must be immediately detected by the Customer through the acceptance of the package with reservation affixed on the courier’s proof of delivery, and must also be communicated within 48 (forty-eight) hours from receipt to Perris Store, by registered letter with return receipt or other equivalent technology. Otherwise and, in particular, once signed the document of the courier without any dispute, the package will be considered received without any reserve.

  1. Return of Products

If the Products are returned to Perris Store by the courier with the cause “address unknown”, the Customer will be contacted by Perris Store and may choose to have the order reshipped, if the Product is still available, or to be refunded the amount already paid. If the order consists of more than one Product, we reserve the right to proceed directly to refund the amount paid by the Customer, if more than one Product has been returned to us on the same Order Form, with the cause “address unknown” specified. If the cause of the return of the Products to Perris Store by the courier is “address unknown”, (parcel) “not collected” or (parcel) “refused”, Perris Store does not guarantee the possibility for the Customer to reserve the same Products if they are out of stock, being able, as a consequence, to proceed to the refund of the order. If, in the latter three cases, the impossibility of delivery is due to a fault attributable to the Customer, Perris Store reserves the right to charge the shipping costs for the return to the Customer.

The Customer has the right to withdraw from the Agreement concluded with Perris Store, without any penalty and without specifying the reason, within 14 days starting from the day in which the Customer or a third party, other than the courier, acquires physical possession of the Product. The date indicated on the courier’s delivery document will be considered the authentic date. The right of withdrawal must be exercised by the Customer by sending a written notice to Perris Store, by e-mail or regular mail, containing the manifestation of intent to exercise the right of withdrawal as well as

  • the indication of the order number that gave rise to the Agreement from which you intend to withdraw;
  • the product code;
  • the number of products ordered;
  • the date of the order;
  • the delivery date;
  • the name of the buyer;
  • the address of the buyer.

For the purposes of compliance with the withdrawal period, it is sufficient that the customer sends the communication relating to the exercise of the right of withdrawal within the expiry of the withdrawal period, which must necessarily follow confirmation by registered letter within 48 hours.

In the event that the Customer exercises the right of withdrawal, the Customer must return the Products to the Perris Store without undue delay and, in any case, within 14 (fourteen) days from the date of the withdrawal notice. The term is thus respected if the Customer returns the Products before the expiry of the period of 14 (fourteen) days starting from the sending of the withdrawal notice. The Products shall be returned to the following address: P.za Giuseppe Malvezzi, 6, 25015 Desenzano del Garda BS. The Products must be returned in a normal state of preservation, after having been kept and used with due diligence.

If you terminate this Agreement, you will be refunded all payments you have made to us, including shipping costs incurred, without undue delay and in any event no later than 14 days after the day on which we are notified of your decision to terminate the Agreement. Said refunds will be made using the same payment method used for the initial transaction, unless the Customer has expressly notified Perris Store otherwise. A refund may be withheld by us until we have received the Goods or until you have demonstrated that you have returned the Goods. You are responsible for all costs associated with the return of the Products. Products must be returned undamaged and in their original packaging.

If the Customer does not exercise his right of withdrawal in accordance with the terms and conditions of this clause, he will not be entitled to a refund.

  1. Competent Court

In case of dispute arising from the interpretation of the Agreement and/or connected, directly or indirectly, to the Agreement, the competent court is ”) , which is the judge of the place of residence or domicile of the Customer, if located in the Italian territory.

The Agreement is governed by Italian Law.

  1. Miscellaneous

Without prejudice to mandatory legal regulations, if the purchased Product is destined for markets outside the European Union, it will be the Customer’s responsibility to inform Perris Store in writing of all the regulations applicable to the Product in the country of destination, including the technical specifications, also relating to product safety, and customs and import regulations.  It is also understood that the Customer assumes sole responsibility for any non-compliance of the Product with the aforementioned regulations, and shall hold Perris Store harmless and indemnified against any prejudice deriving therefrom.
